Welcome! These Terms of Service ("Terms") govern your use of our services and website. By engaging with Kate Keiley Designs, you agree to the following terms.

1. Project Scope & Communication

Before beginning any project, we will define the scope of work together. As the project progresses, changes may arise — if so, we’ll discuss and agree upon any revisions, including possible timeline or cost adjustments.

To ensure a smooth and successful experience, consistent communication is key. You agree to provide timely feedback, and I commit to providing regular updates (ideally weekly or fortnightly).

  • Office Hours: Monday to Friday, 9:00 am – 5:00 pm AWST
  • Response Time: Up to 48 hours (business days)
  • Urgent Issues: Can be flagged by text for prioritisation

2. Respectful Conduct

This working relationship is based on mutual respect and professionalism. While open and honest feedback is encouraged at any time, all communication must remain professional and respectful.

Abusive behaviour or aggression will not be tolerated. If such behaviour occurs, Kate Keiley Designs reserves the right to terminate the project or service immediately. All work completed up to that point will be invoiced, and no refunds will be provided for any unused time or services.

3. Content Responsibility

Clients are responsible for providing content (e.g. text, copy) in a clear, accessible format such as a Word document. This ensures a smoother and more efficient workflow.

  • All content must be approved by you before publishing.
  • We do not proofread or edit content provided.
  • If needed, copywriting support can be arranged at an additional cost.

Content revisions: Two rounds of editorial revisions are included for any supplied copy. Any further rounds of copy editing or content change requests will be billed at our standard hourly rate.

4. Billing & Payment

Web Design Projects

  • Option 1: Full upfront payment
  • Option 2: Payment plan via Procuret (3–6 months)
  • Option 3: Staged payments – 50% upfront, 20% on draft delivery, 30% at soft launch

Late payments (more than 14 days overdue) may result in the project being paused until payment is received.

Hourly / Ad Hoc Design & Creative Services

Ad hoc work is billed at an hourly rate invoiced in arrears. There are no fixed deadlines unless previously agreed. Tasks are scheduled based on current availability and prioritisation.

Monthly Services: SEO & Website Maintenance

SEO services and website maintenance plans are billed monthly. Payment is required before the start of each billing cycle.

If payment is overdue by more than 14 days, the service may be suspended or cancelled, and functionality or data loss may occur. Kate Keiley Designs is not responsible for loss of SEO momentum, analytics data, plugin updates, or website functionality due to missed payments.

5. Hosting Terms

If hosting or email services are provided through Kate Keiley Designs, all hosting-related invoices are subject to the same 14-day payment term.

If payment is overdue by more than 14 days, hosting or related services may be suspended or cancelled, which may result in loss of data. You are responsible for backing up your website and content unless otherwise agreed in writing.

6. Design Revisions

Each project includes two rounds of design revisions (e.g. layout, styling, visual elements). Additional revisions beyond these two rounds will be billed hourly at the current rate.

7. Project On Hold

If you need to pause a project for any reason, your project files will be securely stored for up to six months. After this period, a reminder will be sent before any files are permanently deleted from the archive.

8. Cancellations

If a project is cancelled by either party:

  • All completed work and time spent up to the date of cancellation will be invoiced.
  • All deliverables completed to date will be provided.
  • Ownership rights transfer to you once the final balance is paid in full.

9. Deadlines & Delivery

Website projects typically take 1–2 months depending on scope. Ad hoc or hourly work will be completed as availability allows.

Timelines rely on the timely delivery of content and feedback. Delays in response may impact the project schedule. If a task is time-sensitive, please flag it when requested.

10. Ownership & Usage Rights

Once your account is paid in full, all rights to the completed work are transferred to you. This includes designs, websites, and other deliverables created under your agreement.

11. Limitation of Liability

Kate Keiley Designs is not liable for:

  • Business loss, income loss, or data loss
  • Delays caused by third-party platforms or services
  • Errors in client-supplied content
  • Service interruptions caused by overdue payments or external providers

12. Changes to These Terms

Kate Keiley Designs reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the most current version of these Terms.
